Well, at least the domain which is taking /etc/php5/cgi/php.ini as php.ini does use mod-php....

No, maybe, the php-starter file is not ok, because there the location of the php.ini is defined.

PHPRC="/var/www/fcgi/domain.tld/php5/"
export PHPRC

you find theese files in /var/www/fcgi/domain.tld/...
